Terms and conditions

FIRST. GENERAL PROVISIONS

This document contains the Terms and Conditions of Use (hereinafter, "TCOU"), applicable to all acts celebrated and transactions executed through the web portal owned by WAKA-S TEXTILES FINOS S.A.C. with RUC No. 20453995241, which operates under the brand name K-Tech on the website www.ktech.pe and its related derivatives (hereinafter, "The Site").

The TCOU shall apply strictly to:

  1. The purchase and sale of clothing, technical apparel, accessories, and related products (hereinafter, the "Products") through "The Site".

  2. Access, registration, and use of "The Site" by users.

Any natural or legal person wishing to access and/or purchase on The Site (hereinafter, "the User" or "the Buyer") may do so provided they accept these TCOU, which are binding and mandatory. If these terms are not accepted, the User must immediately refrain from using The Site.

SECOND. ACCEPTANCE AND MODIFICATION

Accessing, using, and placing orders on The Site implies full acceptance of these TCOU. WAKA-S TEXTILES FINOS S.A.C. reserves the right to modify, update, or change the TCOU at any time to adapt them to legislative or commercial changes, by publishing the updated version on The Site. The new terms will become effective from the moment of their publication.

THIRD. LEGAL CAPACITY

The services and products of The Site are available only to those persons who have the legal capacity to contract under Peruvian law. Minors or legally incapacitated persons may not conduct transactions.

FOURTH. ACCOUNT REGISTRATION AND SECURITY

The User can browse the website without registering, but to complete a purchase, they must provide truthful, accurate, and up-to-date shipping and billing information. If the User decides to create an account on the platform:

  • The account and password are personal, unique, and non-transferable.

  • The User is solely responsible for maintaining the confidentiality of their access key.

  • WAKA-S TEXTILES FINOS S.A.C. reserves the right to reject, suspend, or cancel any account registration if it detects false, suspicious data, or fraudulent activities, without this generating any right to compensation.

FIFTH. OFFER, PRICES AND STOCK

  • Prices: All product prices on The Site are expressed in Soles (S/) and include the General Sales Tax (IGV). They do not include shipping costs, which are calculated transparently before finalizing the order.

  • Availability: Product offers have limited stock. In the exceptional case that a purchased product is out of stock, K-Tech will immediately notify the Buyer via email, giving them the option to cancel the purchase (with a full refund of their money) or exchange it for another product.

  • Images: Photographs and graphic representations of garments and technical products are for reference, aiming for the greatest possible accuracy with the actual product.

SIXTH. PAYMENT METHODS

Payments will be processed securely through the authorized payment gateways on The Site:

  1. Openpay: Accepts credit and debit cards (Visa, MasterCard, American Express, and Diners Club), bank transfers from major entities (BCP, BBVA, Interbank, Scotiabank), and cash payments through authorized agents (Kasnet, Tambo, PagoEfectivo).

  2. PayPal: For national or international transactions enabled on the platform.

In case of any suspicion of electronic fraud or unauthorized use of cards, the User must notify K-Tech as soon as possible at support@ktech.pe. WAKA-S TEXTILES FINOS S.A.C. is not responsible for bank fraud but will collaborate with the client and the payment gateway to mitigate the incident.

SEVENTH. THE PURCHASE PROCESS (CHECKOUT)

To purchase any product, the Buyer agrees to follow the automated flow on The Site:

  1. Browse categories/products and add selected garments to the shopping bag.

  2. Click the "Checkout" button and validate the order summary.

  3. Complete the "Contact and Shipping Information" section (email, first name, last name, identification document, phone number, exact address, department, province, and district).

  4. Choose the available shipping method based on your location.

  5. Select your preferred payment method (Openpay or PayPal).

  6. Define the billing address (either the same as shipping or a different one).

  7. Review the final summary and click "Finalize Order". Once payment is confirmed, the system will send an automatic confirmation email.

EIGHTH. SHIPPING AND DISPATCH POLICIES

All K-Tech shipments originate and are processed from our distribution center located in the city of Arequipa, Peru.

  • Data Responsibility: The Buyer is solely responsible for correctly entering the delivery address. If the courier cannot deliver the order due to erroneous or incomplete data or the absence of people at the address, the re-shipment will be at the customer's expense.

  • Logistics Operators: Shipments are made through first-class strategic partner companies: Olva Courier, Urbano Express, and DHL (for international shipments).

  • Costs and Delivery Times: Delivery times are calculated in business days from payment confirmation. Specific costs and times for Arequipa, Lima, Provinces, and abroad will be dynamically calculated at checkout.

  • Campaign Saturation: During periods of high e-commerce demand (Cyber Days, Black Friday, Christmas campaigns, etc.), shipments may experience additional delays of 3 to 4 business days due to saturation of logistics operators.

  • Receipt: All orders must be received by an adult, who must identify themselves with their DNI to sign the delivery conformity document.

NINTH. EXCHANGES, RETURNS AND RIGHT OF WITHDRAWAL

To request an exchange or return of any product purchased on The Site, the User of the platform must strictly adhere to the conditions, deadlines, and garment statuses stipulated in our Exchange and Return Policy published independently on The Site.

TENTH. INTELLECTUAL PROPERTY

All visual content, designs, photographs, logos, texts, technology and materials (or other brand elements), software, codes, and trademarks displayed on The Site are the exclusive property of WAKA-S TEXTILES FINOS S.A.C. or are duly licensed. The reproduction, copying, distribution, or commercialization, in whole or in part, of any element of The Site without the prior, express, and written authorization of the company is strictly prohibited.

ELEVENTH. LIMITATION OF LIABILITY

WAKA-S TEXTILES FINOS S.A.C. is not responsible for:

  1. Unforeseen system interruptions, Shopify server crashes, cyber attacks, or technical failures beyond the company's reasonable control.

  2. The misuse or malicious use of The Site or personal passwords by users.

  3. In no case shall the company's liability to the Buyer exceed the amount actually paid by the latter for the product in question.

TWELFTH. APPLICABLE LAW AND JURISDICTION

These TCOU are governed by and interpreted in accordance with the laws of the Republic of Peru. Any dispute arising from this document that cannot be resolved by mutual agreement between the parties will be submitted to the jurisdiction of the judges and courts of the Judicial District of Arequipa, Peru.
