3. REGARDING THE PROCESSING OF PERSONAL DATA – "CLIENTS" DATABASE

  • 3.1. Purposes of Processing: WAKA-S TEXTILES FINOS S.A.C. will process personal data solely for the purpose of executing, managing, processing payments, and administering the commercial relationship of purchases made on the K-Tech website, including product shipping.

  • 3.3. Mandatory Nature: To carry out product delivery and billing, it is mandatory for the user to provide the indicated data.

  • 3.4. Consequences of not providing the data: If the mandatory data is not provided, the purchase cannot be processed, nor can the purchased products be shipped.

  • 3.5. Recipients and Transfer of Personal Data: To fulfill the purpose of purchase and delivery, WAKA-S TEXTILES FINOS S.A.C. securely transfers data to the following service providers (data processors):

    • E-commerce and Storage Platform: Shopify Inc.

    • Payment Gateways: Openpay Perú S.A.C. and PayPal Inc.

    • Courier and Logistics Companies: Olva Courier S.A.C., Urbano Express Perú S.A., and DHL Internacional (for international shipments).

  • 3.6. Retention Period: Data will be retained during the commercial relationship and for the subsequent legal period of five (5) years applicable to commercial and tax matters.

4. REGARDING THE PROCESSING OF PERSONAL DATA – "MARKETING AND ADVERTISING" DATABASE

  • 4.1. Purposes of Processing: If explicit consent is received from the user, WAKA-S TEXTILES FINOS S.A.C. will process the data to send advertising information, news, promotions, and exclusive offers from the K-Tech brand.

  • 4.2. Personal Data Collected: Full name, email, and phone number.

  • 4.3. Recipients and Transfer of Personal Data: For the deployment of marketing campaigns and web analysis, data may be shared with:

    • Mailing Tools: Shopify Email.

    • Analytics and Advertising Tools: Google LLC (Google Analytics) and Meta Platforms, Inc. (Meta Pixel).

  • 4.4. Retention Period: Data for commercial and marketing purposes will be retained indefinitely until the user decides to withdraw the granted consent.

5. REGARDING THE PROCESSING OF PERSONAL DATA – "COMPLAINTS AND CLAIMS" DATABASE

  • 5.1. Purposes of Processing: To respond to complaints, claims, or suggestions submitted by users, in strict compliance with the provisions of the Consumer Protection Code and the Peruvian Claims Book Regulation.

  • 5.2. Data Collected: Full name, type and number of identity document (DNI/RUC/Passport), address, phone number, email, description of the claim/complaint, and signature.

  • 5.3. Recipients and Transfer of Personal Data: WAKA-S TEXTILES FINOS S.A.C. will not transfer this personal data to third parties, unless there is an express legal obligation or formal requirement from the competent authority (INDECOPI).

  • 5.4. Retention Period: Personal data housed in the Claims Book will be processed during the claim resolution process and will be retained for a maximum period of two (2) years from the submission of the complaint or claim.

6. EXERCISE OF ARCO RIGHTS

For all purposes indicated in this policy, you may exercise your rights of Access, Rectification, Cancellation, and Opposition (ARCO Rights), as well as withdraw the consent granted for marketing purposes, completely free of charge by sending a formal request to the email address: derechosarco@ktech.pe.

If you believe that your rights have not been properly addressed, you have the right to file a complaint with the National Authority for Personal Data Protection, by addressing the Mesa de Partes of the Ministry of Justice and Human Rights (Calle Scipión Llona 350, Miraflores, Lima, Peru).
